ACCEPTANCE OF TERMS
The following terms and conditions, (these “Terms”) are entered into by and between you and peppy, Inc. (“Peppy Group” “Company,” “we,” “us” or “our”). These Terms govern your access to and use of our website, www.peppyforall.com (the “Site”) and your purchase or use of products or services offered by us, whether through the Site or otherwise (collectively and together with the Site, the “Services”).
Please read these Terms carefully. By accessing, browsing or otherwise using the Services or by clicking to accept or agree to the Terms when this option is made available to you, you (1) acknowledge that you have read and understood these Terms, (2) represent and warrant that you meet all of our eligibility requirements for using the Services as described in these Terms, and (3) accept and agree to be bound by these Terms, including any other terms applicable to the Services that are incorporated herein by reference. If you are using the Services on behalf of an entity, you are agreeing to these Terms for that entity and are representing to us that you have the authority to bind that entity to these Terms (in which case “you” will refer to that entity). If you do not accept these Terms or do not satisfy the eligibility requirements set forth below, you may not access or use the Services.
In addition to these Terms, your use of any Services may also be subject to specific terms applicable to a particular Service (“Additional Terms”). To the extent that there is an express conflict between these Terms and any Additional Terms you and the Company have agreed to in connection with any Services, the Additional Terms shall govern with respect to the conflict.

We reserve the right to update and revise these Terms at any time. We’ll make sure to also change the “Last Updated” date at the top of this page so you can tell if these Terms have changed since your last visit. Any such changes are effective immediately when we post them and apply to all access to and use of the Services thereafter. Please review these Terms regularly because once we post any changes, your continued use of the Services constitutes your acceptance of the revised Terms.
ACCESS TO SERVICES
By accessing the Services, you warrant that:
1. You are legally capable of entering into binding contracts;
2. All registration information you submit is truthful and accurate;
3. You will maintain the accuracy of such information; and
4. Your use or purchase of the Services does not violate any applicable law or regulation.
ACCOUNT REGISTRATION
To purchase the Services, you are required to register with the Site and create a user account (“Account”). If you create an Account, you are solely responsible for any activity that occurs through your Account. In order for us to provide you the best possible service, you agree to provide us with complete, accurate, and updated information for your Account at all times. You agree that all information that you submit upon creation of your Account is accurate and truthful and you have the right to provide the content to the Site. If any information is incorrect or outdated, it can lead to errors or delays, for which we will not be responsible.
You should not share your Account information. You should not use another person’s Account or registration information for the Services without permission. Similarly, no one else should be able to use your Account without permission. You are solely responsible for keeping your Account and Account password secure and for any consequence resulting from your failure to do so. You should never publish, distribute, or post login information for your Account.
We have the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms. You can always delete your Account by emailing us at hello@peppyforall.com.
PAYEMENT PROCESSOR
In the course of your use of the Services, third party payment service providers may receive and implement updated credit card information from your credit card issuer in order to prevent your payment or subscription from being interrupted by an outdated or invalid card. This disbursement of the updated credit card information is provided to third party payment service providers at the sole election of your credit card issuer. Your credit card issuer may give you the right to opt-out of the update service. Should you desire to do so, please contact your credit card issuer.
Our obligation to provide the Services only comes into being when we take receipt of your purchase of the Services. Prices include local taxes. You agree not to hold us responsible for banking charges incurred due to payments on your account.
PAYMENT INFORMATION
After you have made your product selections and provided your shipping information, you will see a prompt for your payment details, such as your credit card information and any promotional codes you may have. By entering your payment information and submitting your order, you authorize us and our third party payment processors to charge the amount of the order to your selected payment method.
ELIGIBILITY
We only permit individuals who are at least 18 years old, or the age of majority in your province, territory or country, and who can form legally binding contracts with us to use the Services. Individuals under the age of 18, or the applicable age of majority, (“Minors”) may utilize the Services only with the consent and support of a parent, legal guardian or other qualified adult. If you are a parent or guardian and you allow your Minor to use the Services, you agree to be bound by the Minor’s use of the Services and by these Terms. If you are a Minor and do not have the requisite parent or guardian consent, please do not attempt to access or use the Services.
You can only use or receive the Services to the extent the laws of your jurisdiction or the United States do not bar you from doing so. Please make sure these Terms are in compliance with all laws, rules and regulations that apply to you. You are solely responsible for ensuring compliance with the laws of your specific jurisdiction, including the specific laws of your jurisdiction regarding the import, export, or re-export of the Services.
Your use of the Services means you represent and warrant that you meet all eligibility requirements we outline in these Terms. We may still refuse to let certain people access or use the Services. We may also change our eligibility criteria.

Limitation of liability:
By using the Services, you agree that the liability of Peppy, its parents, affiliates, related companies, officers, directors, employees, agents, representatives, partners and licensors, shall be limited to the maximum extent permissible by applicable law. In no case shall Peppy, its directors, officers, employees, affiliates, agents, contractors, principals, or licensors be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or any Content or for any other claim related in any way to your access to the Platform and/or use of the Services, including, but not limited to, any errors or omissions in any Content or information on the Platform, or any loss or damage of any kind incurred as a result of the use of the Services and/or reliance on any Content or information on the Platform.
Disclaimer of representations and warranties:
Your access to and use of the Services or any Content are at your own risk. You understand and agree that the Services are provided to you on an "AS IS" or "AS AVAILABLE" basis. Peppy makes no warranty or representation and disclaim all responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security, security and non-compatibility or reliability of any Content; (ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of any Content; (iii) the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Services; and (iv) whether the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained through the Content, will create any warranty or representation not expressly made herein or therein.
Rules of Customer Conduct
Terms:

B) Peppy prohibits discrimination against delivery partners under any circumstances and on any grounds including on the basis of race, religion, caste, place of origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristics that may be protected under applicable law.
C) We reserve the right to withhold access to the Platform and otherwise limit Your access to the Platform at Our absolute discretion if You behave towards any delivery partner working with Peppy in a manner which is discourteous, disrespectful, or abusive, or which otherwise may be deemed to be inappropriate or unlawful.
D) You are expected to treat all delivery partners with courtesy and respect.
Trademark, Copyright and Restriction
This site is controlled and operated by Peppy Cartel Pvt. Ltd. and products are sold by them. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. Material on Platform is solely for Your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other Platform or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which You receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

Warranty Clause for our Massagers:
Warranty Period: Our massagers are covered by a limited warranty for a period of 3 months from the date of purchase. The warranty applies only to the original purchaser.
Covered Defects: During the warranty period, we will repair or replace, at our discretion, any massager found to have manufacturing defects or material deterioration, including but not limited to:
- Material deterioration, such as tearing, cracking, or warping of the TPE material under normal use.
- Melting or softening of the TPE material not caused by external heat or misuse.
- Electrical or mechanical defects, including failure of the motor, integrated circuit, or battery components that impact the product's functionality.
- Structural defects that affect the normal operation of the massager, such as wiring malfunctions, motor breakdowns, or circuit issues.
Exclusions: The following are not covered under this warranty:
- Discoloration or fading of the material, which may occur naturally over time due to use and cleaning.
- Damage due to misuse, improper care, failure to follow care instructions, exposure to extreme heat or moisture, or the use of incompatible lubricants (oil-based or silicone-based).
- Damage caused by improper charging (for rechargeable models), including the use of incorrect or non-recommended chargers.
- Cosmetic wear and tear, including minor scratches, surface marks, or damage caused by improper storage or accidental impact.
- Water damage due to improper sealing or submersion in water beyond the product's specified water resistance rating (if applicable).
Claims Procedure: To make a warranty claim, the customer must provide:
- Proof of purchase (e.g., receipt or invoice).
- A clear description of the defect, including photos or videos, if possible.
The warranty covers the repair or replacement of the defective product or components only. The customer may be responsible for shipping costs to return the defective product, depending on their location and the circumstances of the claim.
This warranty is void if the product has been altered, repaired, or opened by anyone other than the manufacturer or an authorized service provider. Additionally, using non-recommended chargers or components may void the warranty for products with motors or integrated circuits.
